you can say that again sista, I dated crazy, that shit is not fun, anywho I was watching the news coverage and they had a divorce lawyer on and said the fact Katie is seeking sole custody and not joint means this will be a nasty divorce and there is no way around it.

Katie Holmes is single in the city this summer -- and she's holding up just fine.

Less than one week after filing to divorce her husband of five years, Tom Cruise, Holmes, 33, is slowly made her way out of hiding, running errands with her daughter, Suri, 6, in New York City on Wednesday's July 4th holiday.

Shopping for groceries including ground beef, hamburger rolls and strawberries with Suri in tow, Holmes spoke out for the first time since her Thursday filing. "I'm alright," the actress told a New York Daily News reporter as she browsed the aisles in Whole Foods. "Thank you."

Since calling it quits with Cruise, 50, Holmes appears to be in much better spirits as she prepares to fight for sole custody of the couple's daughter. (Cruise also has two older children, Connor and Isabella, with ex-wife Nicole Kidman).

"She's been miserable for a long time, but the last couple of weeks, she's been happy -- like she's been set free," an insider tells Us Weekly of Holmes, who moved out of the NYC home she shared with Cruise and into her own rented apartment weeks before her filing.

A second Holmes source confirms that the actress is keeping Suri's best interests in mind as she moves on to this new phase of her life without Cruise.

"Every move she made and everything she did was controlled…She felt like she was in Rosemary's Baby," the source tells the new issue of Us Weekly, referring to the classic 1968 horror film, in which an aspiring young actress [Mia Farrow] unwittingly bears a child for her husband's Satanic cult.

"This is about protecting her daughter," the source says.

Katie Holmes files for emergency custody hearing

Katie Holmes has filed for an emergency custody and child support hearing in New York. The 33-year-old actress - who began divorce proceedings against estranged husband Tom Cruise last week - requested an ''emergent application'' in New York City court yesterday to determine immediate custody and child support issues over the couple's six-year-old daughter, Suri.

The filing means Cruise - who is being represented by Dennis Wasser, one of Los Angeles' top divorce lawyers - will have to hire his own New York-based attorney and the couple will have to appear before Judge Matthew Cooper on July 17 in an open court.

A source said: ''Katie filed an 'emergent application' in New York City on July 3. It's a motion seeking temporary emergency relief, which can include child support and custody. It also means that Tom is going to have to hire a New York lawyer - he can't use his California lawyer anymore. The motion also means that both Tom and Katie have to be present in court on July 17. A judge is now assigned to their case, which means it's no longer going to be an out-of-court settlement. They are scheduled to appear before Judge Matthew Cooper on July 17 at 9:30 a.m.''

Insiders believe Holmes - who married Cruise in November 2006 - took out the emergent application because she didn't think the 50-year-old actor would cooperate with her.

The source added to website Hollywoodlife.com: ''Katie doesn't anticipate Tom cooperating, and there have been rumors that he's going to file in California and argue that litigation should be there rather than New York. Bottom line: if you file an emergency motion, you don't believe there's going to be cooperation from the other party or you need an order that only the court can give. It might have something to do with trying to control the media. They filed under anonymous verses anonymous to avoid the media. Most celebs do that.

''It's unlikely for a celebrity to file an emergency hearing, because most celebrities settle out of court because they don't want the media involved in their case. Katie and Tom are now going to have an open court room, which means that anyone can walk in and see what's happening. Plus, they are putting their case in the hands of a judge who is going to determine what happens next. Most public figures don't want that - it's a last resort. It's super-aggressive for Katie to have taken these steps. It suggests that there's going to be a contentious divorce battle to come.''

What i gagged on was the fact that he didn't want to call her by her REAL name...Katie. He called her "Kate" because HE felt it wasn't childish and it was more age appropriate. :umm: :umm: :umm: Bitch, her name is KATIE. :wtf:

During an interview with All Headline News, he explained, “Katie is a young girl’s name. Her name is Kate now – she’s a child-bearing woman.” At the time, it was also reported that Holmes had agreed upon the name change “after discussing it with Tom” and as a result “all friends and family now call her Kate.”

Except none of them did, so that didn’t really pan out.

Katie's Cruise kidnap fear as 'Scientology' goons eye building

Katie Holmes fears she can’t take one step without a Scientology goon following her every move in a heavy- handed intimidation attempt, multiple sources close to the actress told The Post yesterday.

The pretty actress last night was holed up in her Chelsea pad — terrified that soon-to-be-ex-hubby Tom Cruise might kidnap their little girl, law-enforcement sources said.

Holmes told another building resident of her abduction fear — and that neighbor called police on Friday, sources said.

But without Holmes phoning in the report herself — and Cruise known to be 2,600 miles away shooting a movie in Iceland — police couldn’t take any action.

Managers at Holmes’ plush Seventh Avenue building, though, have been put on alert for Cruise or any strangers who might want to get inside, the sources said.

Holmes, who filed for divorce from superstar Scientologist actor Cruise last week, knew this was coming, the sources said.

“Katie saw all the pressure. They [scientologists] are professionals at pressuring people to be quiet,” said a friend of the actress after her bombshell divorce filing in Manhattan last week. “That’s why she did this [filed for divorce] in secret.”

A team of beefy armed men parked themselves in a white Cadillac Escalade outside Holmes’ place all day yesterday, snapping pictures of people outside the building and demanding to know who they were.

Cops finally pulled up in a marked NYPD squad car behind the SUV and checked out its Tennessee license plates. The officers said they were acting on complaints of “suspicious activity in a white Escalade” but did not elaborate. They spent about 15 minutes eyeing the SUV before leaving. At least two of the five men sitting in the SUV were clearly packing heat. When asked who they worked for, one wisecracked: “We’re waiting for a bus.”

A Holmes rep said the mystery men weren’t with the actress.

Cruise’s team denied the guards were working for the actor. A Scientology lawyer told TMZ the church is not tailing Holmes.

The actress and her daughter, Suri, were not seen in public all day yesterday.

Now that Suri, is 6, Holmes reportedly wants to take her as far away from Cruise’s Scientology pals as possible.

Holmes, who was born in Ohio and raised Catholic, is seeking full custody so that Suri can be shielded from alleged Scientology brainwashing, sources said.

“Suri is at the age where they are going to start educating her in Scientology centers and indoctrinating her into the religion,” Holmes’ pal said.

“Katie did convert when she and Tom were married, but she didn’t take to [scientology]. Behind closed doors, and when the private planes and the red carpets were gone, she didn’t like it. And she decided she does not want that for Suri. ”

Holmes had been planning her marital escape for weeks, surreptitiously moving with Suri into the Chelsea apartment while Cruise was out of the country.

The box-office superstar Cruise was spotted working on the set of his movie “Oblivion” yesterday in Iceland.

Holmes told her neighbor she was afraid he’d charter a plane to get back to New York.

“[Holmes] did not want that much influence and power and control [from the Church of Scientology] over her child and didn’t want to go through with” her education in it, according to Holmes’ friend.

“She was not going to let that happen to her daughter. Katie does not want them making all the decisions for her child,” the source said.

Cruise’s first two wives, Mimi Rogers and Nicole Kidman, reportedly also had problems with the church’s hold on their then-husband.

Another former Hollywood wife, actress-photographer Carmen Llewellyn, who was married to “My Name is Earl” actor Jason Lee — a Scientologist — has said the reprisals are swift and brutal against spouses who leave mates who are in the church.

“I lost my manager and my career,” Llewellyn said in a published interview after her split from Lee. “People didn’t return my phone calls.

“Scientologists followed me down the street. They took pictures of my kids. They’d stake out my house, wait until we came our and follow us. They came looking for me to scare me.”

Cruise, who turns 50 tomorrow, and Holmes, 33, were married on Nov. 18, 2006, in a lavish Italian ceremony.

Holmes reportedly signed a prenuptial deal that will give her $3 million for each year of marriage, meaning she could walk away with a cool $15 million — and a mansion in Santa Barbara County, Calif.

the scientologists don't play around.

too many stories say they don't and they get a fucking attitude if you ask too many of the right questions. As for Katie I highly doubt that she would take such a public route to divorce if she didn't have mad tea on Tom to spill, if this goes quietly it will be because Katie got what she wanted. Frankly I'm happy for Katie to finally be free of someone who is clearly as nutty as squirrel shit. :filenails:
